1. Agreement and operator

These Terms of Use are an agreement between you and Dylan Seaton, an individual in Arkansas who operates Project Warfighter ("Project Warfighter," "we," "us," or "our"). You agree to this version only when you select the explicit Terms acceptance control and submit it through Project Warfighter's legal review flow. Creating an account, accessing the site, or merely using the beta does not by itself record agreement to these Terms. If you do not agree, do not select the acceptance control or use features that require acceptance.

Our Privacy Notice explains our handling of personal data. Our Consumer Health Data Privacy Policy separately explains health-related data and the consent required before Project Warfighter processes it.

2. Beta eligibility

This beta is offered only to people who are at least 18 years old and participating from the United States. We ask for an eligibility attestation, not a birth date, home address, or state of residence. You must be legally able to enter this agreement.

3. Independent beta service

Project Warfighter is an independent fitness and readiness tool. It is not an official product of, affiliated with, sponsored by, or endorsed by the United States Department of Defense, Department of the Air Force, or any military service. References to public military standards and publications identify sources; they do not imply endorsement.

The service is a beta. Features may be incomplete, unavailable, corrected, or changed. We may limit enrollment or pause a feature to protect members, data, or system integrity. We do not promise uninterrupted or error-free operation.

4. General education, not medical care

Project Warfighter provides general fitness, exercise, readiness, food, hydration, and nutrition education. It does not provide medical care, diagnosis, treatment, rehabilitation, medical clearance, medical nutrition therapy, emergency services, or an individualized professional relationship.

Source-backed does not mean suitable for every person. Follow restrictions and advice from qualified professionals who know your situation. Stop activity and seek appropriate care for injury, worsening pain, severe symptoms, or other concerning warning signs. Call 911 or local emergency services for an emergency.

5. Estimates, plans, and member decisions

Scores, pass projections, readiness categories, progress trends, training plans, exercise alternatives, nutrition substitutions, and time-to-goal information are estimates or educational starting points based on configured rules, cited sources, and information you enter. They can be incomplete, delayed, or wrong. They do not create an official fitness-assessment result and do not guarantee selection, qualification, performance, weight change, health outcome, or injury-free training.

You remain responsible for checking entries, choosing whether and how to act, using safe technique and equipment, following applicable workplace or military rules, and obtaining help when appropriate. Do not use the service to train through a restriction, injury, or warning sign.

6. Accounts and acceptable use

Provide accurate account information, keep your sign-in credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.

• Do not access another person's account or records without permission.
• Do not probe, bypass, disable, or interfere with security, privacy, rate limits, source controls, or data boundaries.
• Do not upload unlawful, abusive, infringing, malicious, or deceptive content.
• Do not use the beta to make medical decisions for another person or present an estimate as an official result.
• Do not use automated means that overload the service or extract member data.

7. Your entries and limited operating permission

You keep any rights you have in information and notes you enter. You give us a limited permission to host, process, reproduce, and display those entries only as needed to provide, secure, troubleshoot, and improve the beta and meet legal obligations. This permission ends when the data is deleted from active systems, subject to limited provider logs, backups, security records, and legal obligations described in the Privacy Notice.

8. Friend Codes and member-controlled sharing

Friend Codes and Wingman requests help members connect. An accepted connection does not expose all records. Current sharing controls are limited, and health, assessment-detail, nutrition, limitation, note, email, and authentication data are not shared by default. Review the preview before creating or sending a progress card or other share.

A recipient can keep, copy, forward, or capture anything you choose to share. Deleting or revoking an in-app connection cannot recover copies already downloaded or sent outside Project Warfighter. Do not share another person's information without permission.

9. Project materials and third-party sources

The Project Warfighter name, original software, layout, graphics, and original content are protected by applicable law. We grant you a personal, limited, revocable, non-transferable right to use the beta for its intended purpose. Public government materials, third-party publications, trademarks, and linked resources remain subject to their own rights and terms. A citation or link does not transfer ownership or guarantee that an external resource will remain available.

Food search and barcode lookup use USDA FoodData Central and Open Food Facts as third-party data sources. Their records can be incomplete, outdated, or inaccurate and remain subject to their own terms, notices, licensing, and availability. Review current product labels and manufacturer information before relying on returned food data.

10. Suspension, termination, and account deletion

You may stop using the service and may use the verified account-deletion flow. We may restrict or end access for material misuse, security risk, legal requirements, or discontinuation of the beta. When practical, we will use a proportionate response and provide notice. Sections that by their nature should continue—including ownership, disclaimers, liability limits, and governing law—survive termination.

11. Disclaimers

To the extent permitted by law, the beta and its content are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not disclaim any warranty or right that applicable law does not allow us to disclaim.

12. Limits of liability

To the extent permitted by law, Dylan Seaton and Project Warfighter will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, opportunities, or profits arising from the beta. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some states do not allow certain exclusions or limits, so they may not apply to you.

13. Governing law and disputes

Please contact privacy@neascan.org first so we can try to address a concern informally. To the extent permitted by law, Arkansas law governs these Terms without regard to conflict-of-law rules. This provision does not waive non-waivable consumer protections or rights available under the law of your home state. These Terms do not require arbitration and do not contain a class-action waiver.

14. Changes and contact

If we materially change these Terms, we will publish a new dated version and request acceptance when required. Earlier accepted versions remain available at their versioned URLs. Continued use alone will not replace an in-app acceptance step when we require one.
